These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Mlinzi Cyber Ltd ("Mlinzi Cyber," "we," "us," or "our"), governing your access to and use of the Mlinzi Cyber cybersecurity training platform, including all associated websites, mobile applications, APIs, content, tools, and services (collectively, the "Platform").
By registering for an account, accessing the Platform, enrolling in any course, or clicking "I Agree," you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree to these Terms, you must immediately discontinue use of the Platform.
These Terms apply to all users worldwide, including learners, corporate subscribers, institutional partners, and administrators. Where local law in your jurisdiction provides greater protections, those protections are not waived by these Terms.
Age Requirement. You must be at least 16 years of age to create an account. Users between the ages of 16 and 18 must have the consent of a parent or legal guardian. Corporate accounts may be created on behalf of minors enrolled in institutional programmes with appropriate institutional authorisation.
Account Accuracy. You agree to provide accurate, current, and complete information during registration and to update such information promptly if it changes. Mlinzi Cyber reserves the right to suspend or terminate accounts where information is found to be false, misleading, or incomplete.
Account Security. You are solely responsible for maintaining the confidentiality of your login credentials. You agree to notify us immediately at [email protected] if you suspect any unauthorised use of your account. Mlinzi Cyber is not liable for any loss or damage arising from your failure to maintain account security.
One Account Per Person. Individual subscriptions are limited to one account per natural person. Sharing account credentials between multiple individuals is strictly prohibited and constitutes a material breach of these Terms.
Corporate and Institutional Accounts. Organisations subscribing to team or enterprise plans may create sub-accounts for authorised employees or students. The account administrator accepts these Terms on behalf of all sub-account users and is responsible for ensuring compliance.
Mlinzi Cyber provides an online cybersecurity education and training platform offering the following services:
Course Library. Access to a catalogue of cybersecurity courses, learning paths, video lessons, interactive labs, quizzes, and assessments covering topics including but not limited to network security, ethical hacking, digital forensics, cloud security, compliance frameworks, and threat intelligence.
Certificates of Completion. Upon successfully completing a course or learning path and passing the associated assessments, users receive a digitally verifiable Certificate of Completion issued by Mlinzi Cyber. Certificates are issued in the user's active language (English, Portuguese, or Swahili) as selected at the time of download.
Diamond Minds Programme. A structured cohort-based training programme designed to train cybersecurity professionals in Botswana and across Africa. Participation is subject to separate programme terms communicated at the time of enrolment.
Corporate Training Solutions. Customised training packages for organisations, including bulk seat licences, progress dashboards, and team management tools.
AI-Assisted Learning Tools. The Platform may incorporate AI-powered features including personalised learning recommendations, automated quiz feedback, and threat intelligence briefings. These features are provided as supplementary tools and do not constitute professional cybersecurity advice.
Mlinzi Cyber reserves the right to modify, suspend, or discontinue any service or feature at any time with reasonable notice where practicable.
Subscription Plans. Mlinzi Cyber offers multiple subscription tiers, including free, individual paid, team, and enterprise plans. The features, pricing, and limitations of each plan are described on the Pricing page and are subject to change with 30 days' notice to existing subscribers.
Billing Cycle. Paid subscriptions are billed on a recurring basis (monthly or annually) on the date you first subscribed, unless cancelled prior to the renewal date. Annual plans are billed in full at the start of each billing period.
Payment Processing. All payments are processed securely through Stripe, Inc. By providing payment information, you authorise Mlinzi Cyber to charge the applicable fees to your designated payment method. Mlinzi Cyber does not store full card numbers or CVV codes.
Taxes. Prices displayed may exclude applicable taxes, including VAT, GST, or withholding taxes, depending on your jurisdiction. You are responsible for all applicable taxes on your subscription. Where required by law, Mlinzi Cyber will collect and remit taxes on your behalf.
Free Trials. Where a free trial is offered, you will not be charged during the trial period. At the end of the trial, your account will automatically convert to a paid subscription unless you cancel before the trial expires.
Refund Policy. Mlinzi Cyber offers a 7-day money-back guarantee for new individual subscriptions. Refund requests must be submitted to [email protected] within 7 days of the initial charge. Refunds are not available for: (a) renewals after the initial subscription period; (b) annual plans after the 7-day window; (c) corporate or enterprise plans (which are governed by separate agreements); or (d) accounts terminated for breach of these Terms.
Failed Payments. If a payment fails, Mlinzi Cyber will attempt to retry the charge up to three times over 14 days. If payment cannot be collected, your account will be downgraded to the free tier and access to paid content will be suspended until payment is resolved.
Currency. All prices are displayed in United States Dollars (USD) unless otherwise specified. Currency conversion is handled by your payment provider and Mlinzi Cyber is not responsible for exchange rate fluctuations.
Issuance. Certificates are issued solely upon completion of all required course modules and achieving the minimum passing score on all associated assessments. Mlinzi Cyber reserves the right to withhold or revoke certificates where there is evidence of academic dishonesty, cheating, or misrepresentation.
Nature of Certificates. Mlinzi Cyber Certificates of Completion are educational credentials issued by Mlinzi Cyber Ltd. They are not equivalent to, and should not be represented as, government-issued professional licences, academic degrees, or certifications from third-party bodies such as CompTIA, ISC2, or EC-Council, unless explicitly stated in the course description.
Verification. All certificates include a unique verification code that can be validated at mlinizicyber.com/verify. Employers and institutions may use this system to confirm the authenticity of a certificate.
Revocation. Mlinzi Cyber reserves the right to revoke any certificate if it is subsequently determined that: (a) the certificate was obtained through fraudulent means; (b) the user's account is terminated for breach of these Terms; or (c) the course content is materially updated and the original assessment is no longer valid.
Intellectual Property in Certificates. The design, branding, and format of Mlinzi Cyber certificates are proprietary. You may not alter, reproduce, or misrepresent a certificate. Presenting a revoked or fraudulently obtained certificate to an employer or institution may constitute fraud under applicable law.
You agree to use the Platform only for lawful purposes and in accordance with these Terms. You must not:
Prohibited Conduct. (a) Use the Platform to engage in, facilitate, or promote any illegal activity, including unauthorised access to computer systems, networks, or data; (b) share, distribute, or resell course content, videos, labs, or materials without express written permission from Mlinzi Cyber; (c) use automated tools, bots, scrapers, or scripts to access, copy, or index Platform content; (d) attempt to reverse-engineer, decompile, or extract source code from the Platform; (e) upload or transmit malware, viruses, or any code designed to disrupt, damage, or gain unauthorised access to systems; (f) impersonate any person or entity, or misrepresent your affiliation with any person or entity; (g) harass, threaten, or abuse other users, instructors, or Mlinzi Cyber staff; (h) use the Platform's cybersecurity knowledge or tools to conduct actual attacks on systems, networks, or individuals without explicit authorisation from the system owner.
Cybersecurity-Specific Restrictions. Given the nature of cybersecurity training, users acknowledge that skills and knowledge acquired on the Platform must only be applied in lawful, ethical, and authorised contexts. Applying techniques learned on the Platform to attack, compromise, or disrupt systems without authorisation is a serious criminal offence in most jurisdictions and constitutes a material breach of these Terms.
Consequences. Violation of this Acceptable Use Policy may result in immediate account suspension or termination without refund, reporting to relevant law enforcement authorities, and civil or criminal liability.
Mlinzi Cyber Content. All content on the Platform, including course materials, videos, text, graphics, logos, software, databases, and the Platform itself, is owned by or licensed to Mlinzi Cyber Ltd and is protected by copyright, trademark, and other intellectual property laws in Kenya, South Africa, the United States, and internationally.
Limited Licence. Subject to your compliance with these Terms and payment of applicable fees, Mlinzi Cyber grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform and its content for your personal, non-commercial educational purposes.
Restrictions. You may not: (a) copy, reproduce, distribute, or publicly display any Platform content without prior written consent; (b) create derivative works based on Platform content; (c) use Platform content for commercial purposes, including resale, training of third parties for profit, or incorporation into other products or services.
User-Generated Content. If you submit content to the Platform (such as forum posts, quiz answers, or feedback), you grant Mlinzi Cyber a worldwide, royalty-free, perpetual licence to use, reproduce, and display such content in connection with the Platform. You represent that you own or have the right to submit such content.
Trademarks. "Mlinzi Cyber," the Mlinzi Cyber shield logo, "Diamond Minds," and related marks are trademarks of Mlinzi Cyber Ltd. You may not use these marks without prior written permission.
Your privacy is important to us. Our collection, use, and protection of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference and available at mlinizicyber.com/privacy.
By using the Platform, you consent to the collection and processing of your personal data as described in the Privacy Policy. Mlinzi Cyber processes personal data in compliance with applicable data protection laws, including the European Union General Data Protection Regulation (GDPR), South Africa's Protection of Personal Information Act (POPIA), Kenya's Data Protection Act 2019, and other applicable national laws.
Where Mlinzi Cyber transfers personal data across borders, it does so in accordance with applicable legal requirements, including standard contractual clauses or adequacy decisions where required.
The Platform may integrate with or link to third-party services, including Stripe for payment processing, LinkedIn and Indeed for job search functionality, and cloud infrastructure providers. These third-party services are governed by their own terms and privacy policies, and Mlinzi Cyber is not responsible for their content, practices, or availability.
Mlinzi Cyber does not endorse any third-party employer, job listing, or external resource linked from the Platform. Job market data displayed on the Platform is sourced from publicly available reports (including ISC2, CompTIA, and Market Data Forecast) and is provided for informational purposes only. Mlinzi Cyber makes no guarantee of employment outcomes.
No Professional Advice. The Platform provides educational content only. Nothing on the Platform constitutes professional cybersecurity, legal, financial, or career advice. You should consult qualified professionals for advice specific to your situation.
No Guarantee of Outcomes. Mlinzi Cyber does not guarantee that completion of any course or programme will result in employment, salary increases, professional certification, or any other specific outcome.
"As Is" Basis. The Platform is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
Limitation of Liability. To the maximum extent permitted by applicable law, Mlinzi Cyber's total liability to you for any claim arising from or related to these Terms or the Platform shall not exceed the greater of: (a) the total fees paid by you to Mlinzi Cyber in the 12 months preceding the claim; or (b) USD 100.
Exclusion of Consequential Damages. Mlinzi Cyber shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, even if advised of the possibility of such damages.
Jurisdictional Limitations. Some jurisdictions do not allow the exclusion of certain warranties or limitations on liability. In such jurisdictions, the above limitations apply to the fullest extent permitted by law.
You agree to indemnify, defend, and hold harmless Mlinzi Cyber Ltd, its officers, directors, employees, agents, licensors, and partners from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Platform in violation of these Terms; (b) your violation of any applicable law or regulation; (c) your infringement of any third-party intellectual property or other rights; or (d) any content you submit to the Platform.
Termination by You. You may cancel your subscription and close your account at any time by contacting [email protected] or using the account settings. Cancellation takes effect at the end of the current billing period. Cancellation does not entitle you to a refund except as provided under the Refund Policy in Section 4.
Termination by Mlinzi Cyber. Mlinzi Cyber may suspend or terminate your account immediately and without notice if: (a) you breach any provision of these Terms; (b) we are required to do so by law or regulatory authority; (c) we reasonably suspect fraudulent, abusive, or illegal activity on your account; or (d) continued provision of services to you would expose Mlinzi Cyber to legal or reputational risk.
Effect of Termination. Upon termination, your right to access the Platform ceases immediately. Mlinzi Cyber may retain your data as required by law or for legitimate business purposes as described in the Privacy Policy. Provisions of these Terms that by their nature should survive termination (including Sections 7, 10, 11, 13, and 14) shall survive.
Governing Law. These Terms are governed by and construed in accordance with the laws of Kenya, without regard to its conflict of law principles. For users in the European Union, mandatory consumer protection provisions of your local law also apply.
Informal Resolution. Before initiating any formal dispute, you agree to contact Mlinzi Cyber at [email protected] and attempt to resolve the dispute informally for a period of 30 days.
Arbitration. If informal resolution fails, any dispute arising from or relating to these Terms or the Platform shall be resolved by binding arbitration administered by the Nairobi Centre for International Arbitration (NCIA) under its rules. The arbitration shall be conducted in English in Nairobi, Kenya. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Class Action Waiver. To the extent permitted by applicable law, you waive any right to participate in a class action lawsuit or class-wide arbitration against Mlinzi Cyber.
EU Users. Users in the European Union may also submit complaints to their national data protection authority or use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
US Users. Users in the United States may bring claims in the state or federal courts located in Cook County, Illinois, for matters not subject to arbitration.
Mlinzi Cyber reserves the right to modify these Terms at any time. We will provide notice of material changes by: (a) posting the updated Terms on the Platform with a revised "Last Updated" date; (b) sending an email notification to your registered email address; or (c) displaying a prominent notice on the Platform.
Your continued use of the Platform after the effective date of the updated Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must discontinue use of the Platform and may cancel your subscription in accordance with Section 12.
Mlinzi Cyber shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, government actions, internet outages, cyberattacks on third-party infrastructure, pandemics, or other events of force majeure. In such circumstances, Mlinzi Cyber will use commercially reasonable efforts to restore services as quickly as practicable.
Corporate and enterprise subscribers are subject to additional terms set out in their Order Form or Master Services Agreement. In the event of any conflict between these Terms and a signed enterprise agreement, the enterprise agreement shall prevail.
Corporate administrators are responsible for: (a) ensuring all sub-account users comply with these Terms; (b) managing user access and promptly deactivating accounts for departing employees; (c) maintaining the confidentiality of administrative credentials; and (d) ensuring that the Platform is used only for the purposes specified in the enterprise agreement.
Mlinzi Cyber is committed to making the Platform accessible to users with disabilities. We strive to comply with the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA. If you encounter accessibility barriers, please contact us at [email protected] and we will make reasonable efforts to accommodate your needs.
Entire Agreement. These Terms, together with the Privacy Policy and any applicable enterprise agreement, constitute the entire agreement between you and Mlinzi Cyber regarding the Platform and supersede all prior agreements.
Severability. If any provision of these Terms is found to be unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force.
Waiver. Mlinzi Cyber's failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
Assignment. You may not assign or transfer your rights under these Terms without Mlinzi Cyber's prior written consent. Mlinzi Cyber may assign these Terms in connection with a merger, acquisition, or sale of assets.
Language. These Terms are written in English. Where translations are provided for convenience, the English version shall prevail in the event of any inconsistency.
